1.1. We are Maglia, a registered company in The Netherlands with the registration number NL002297023B88. We operate the website magliashop.cc (referred to as “Maglia,” “us,” or “we”).

1.2. You can contact us with any questions regarding these Terms and Conditions, as well as any issues related to orders and purchases.

1.3. These Terms and Conditions govern the terms of sale for all orders placed by customers (referred to as “you” or the “Customer”) on the magliashop.cc domain, any subdomains, mobile websites from the moment you place an order until payment and delivery. By ordering a product, you agree to be legally bound by these Terms and Conditions. Please read and understand them before placing an order.

1.4. The Customer and Maglia are collectively referred to as the “Parties.”

1.5. We reserve the right to amend these Terms and Conditions from time to time. The new version will not be retroactive, and the Parties will only be bound by the Terms and Conditions that are online on the day the order is placed.

1.6. In these Terms and Conditions, the following terms have the meanings ascribed to them below:

a) “Site” refers to the domain, subdomains of magliashop.cc, and mobile application. b) “You” refers to the customer who places an order. c) “Customer” refers to the individual who places an order. Purchases made on our Site are only for private individuals and not companies.
d) “Working Day” refers to a day that is neither
     (i) a Saturday or Sunday, nor
     (ii) a public holiday in the Customer’s country.
e) “Order” refers to the order submitted by you to the Site to purchase product(s) from us.
f) “Content” refers to all texts, graphics, videos, pictures, and all other information published on the Site.
g) “Third Party Sites” refers to any site not provided by Maglia.
h) “Contract” refers to the order placed by you for the purchase of product(s) in accordance with these Terms and Conditions.
i) Words indicating the singular shall include the plural and vice versa.

2. ORDERING/ FORMATION OF CONTRACT

2.1. You may only purchase products from us if you are legally capable of entering into a binding contract with us, you are an authorized user of the payment method used to pay for your order, and you may not purchase Maglia products for any commercial and/or business purpose.

2.2. Our Site will guide you step-by-step for finalizing your purchase and placing your order. You will be provided with a summary of the relevant information of your order before placing your purchase. We strongly recommend that you carefully verify all the details of your order before placing your purchase, as we cannot guarantee that we will be able to amend your details afterward.

2.3. Once you have placed your order, we will immediately contact your payment provider for authorization to take payment from your account. We will not process your order until we have received such authorization. If you are using Klarna, other terms may apply.

2.4. Once payment has been accepted, we will send you an email confirming the purchase. This email is acknowledgment of the purchasing contract between you and us.

3. PRICING AND PAYMENT

3.1. Prices listed on the Site apply to all orders made through the Site and include VAT, but delivery costs and any other applicable costs will be charged separately and displayed during checkout. You may also be responsible for customs and import charges. You or a third party must pay any charges on the items you purchased.

3.2. Maglia can change or update information on the Site, including prices, details, and descriptions, at any time without warning.

3.3. If you purchased a product with incorrect information, you can contact customer service.

3.4. We offer various payment methods, which will be displayed during checkout for your country. We do not accept cash or cheques.

3.5. Your chosen payment service provider will validate and authorize your payment. If authorization is not granted, you will receive an email notification, and additional terms and conditions may apply.

3.6. If authorization is not granted, the order will be cancelled, and you will receive an email notification.

3.7. Special offers and discounts for certain products may be available on the Site, with conditions specified at the time of issuance.

3.8. We reserve the right to withdraw special offers or discounts without warning.

3.9. You are responsible for any costs associated with monetary transactions.

4. SHIPPING AND DELIVERY

4.1. The cost of shipping will be added to the price of your purchase, and will be clearly indicated in the ‘Total Cost’ section during checkout.

4.2. We will aim to dispatch your order within three working days, but please note that there may be delays during busy periods, unexpected events, or if the product is out of stock.

4.3. We will check to ensure that the card you used for payment has sufficient funds to complete the transaction. The product will only be dispatched once payment has been authorized.

4.4. Once your order has been dispatched, you will receive an email with an estimated delivery time. The delivery time will start from the moment you receive this email.

4.5. Depending on your location, there will be different delivery options available to you, with the delivery fee varying depending on the option you choose. You can view all the available delivery methods during checkout.

4.6. It is your responsibility to provide us with accurate and complete delivery address information. We cannot guarantee that we will be able to change the address after purchase. Once the products are in your possession, you are responsible for any errors in delivery due to incorrect address information.

4.7. Our carriers will do their best to deliver your order within the promised delivery time, but delays can sometimes occur. If you have not received your parcel within the promised time, please contact our customer service.

4.8. If your delivery is delayed by more than 30 working days, you have the right to cancel your purchase.

4.9. If your parcel is delivered to a specific delivery point, you must collect it within the specified time period. You will need to show valid identification and your order number to retrieve the package. Failure to collect your parcel on time will result in it being returned to us and fully refunded.

4.10. Our carriers do not deliver on weekends or public holidays. Please be aware that delivery times may be longer during sale periods or other busy times.

5. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS

5.1. You have a legal right of withdrawal for 14 days as a consumer, but we offer 30 days for returns. Keep in mind that you can only return products bought through the website.

5.2. RETURNS

5.2.1. You can return products (including gift cards) within 30 days of placing your order for any reason, in addition to your legal right of withdrawal. A return shipping label will be provided with your order, but please contact customer service if you have lost it.

5.2.2. Discounted items can be returned if they are in their original, unwashed condition with all tags still attached.

5.2.3. Maglia will give you a return label, and a return fee will be charged. More information can be found on our website.

5.2.4. Once we receive and process your return, we will issue a refund. This process can take up to two weeks. You will receive a credit memo email, and your refund will be issued within 2 to 5 working days after that.

5.2.5. We do not offer exchanges for returned items. If you want a different item, please place a new order.

5.2.6. All refunds will be made using the same payment method you used to purchase the product. We will refund all payments received from you, including delivery costs (except for additional delivery costs resulting from your choice of a delivery method other than our standard method). Refunds will not include any customs or import charges paid, or any contribution you may have made to our sustainability initiatives (climate contribution fee).

5.3 RIGHT OF WITHDRAWAL

5.3.1 You can withdraw from your contract with us within 14 days without giving a reason. The deadline for withdrawal is 14 days from the day you or a third party you have authorized (other than the carrier) received the items you purchased. To withdraw, you must inform us in writing of your decision to withdraw. You can contact us or use the withdrawal form provided.

You only need to send your withdrawal notice before the deadline expires to exercise your right to withdraw.

5.3.2 If you withdraw from your contract with us and return any items, we will refund you all the payments you made, including the delivery costs (except for any additional costs resulting from your choice of a delivery method other than our standard delivery). We will refund you within 14 days of receiving your cancellation notice or evidence of return, whichever comes first. We will use the same payment method you used for the initial transaction, unless you have agreed otherwise. We will cover the return shipping costs only if you use our provided return label. If you don’t use our label, you will have to pay for the return shipping costs. We can reduce your refund to cover any reduction in the value of the items due to your handling, including any damage that occurred during transit.

5.4 FAIR USE POLICY

If we notice any unusual patterns of return activity, we may investigate and take necessary actions. If we find that you have systematically abused our return policy, we reserve the right to refuse your future purchase requests or deactivate your account temporarily or permanently.

If you believe we have made a mistake in deactivating your account, you can contact our Customer Service. These provisions do not affect your right to return or claim items you have already purchased.

6. LEGAL GUARANTEE OF CONFORMITY

6.1. If you discover any faults in the products you purchased from Maglia, you can benefit from legal guarantee protection under statutory regulations. You have a period of three years from the date of receiving your items to make a claim for your legal guarantee, provided that you report the defect in a timely manner. Any complaints filed within two months of discovering the defect are deemed to be filed within a reasonable timeframe. To initiate a complaint, please get in touch with our customer service department through the contact information provided on our website.

7. LIMITATION OF LIABILITIES AND WARRANTIES

7.1. We do not guarantee the availability, accuracy, or reliability of the information, materials, or contents provided on this Site. We are not responsible for any errors or misleading information on the Site. We are also not liable for any loss of business, revenue, contracts, opportunity, or reputation. Our liability is limited to the total price of your order.

7.2. Any information or contents found on the Site should not be interpreted as advice from Maglia

7.3 You are not allowed to use our products for commercial or business purposes. We are not liable for any loss of revenue, profits, contracts, business, opportunity, or reputation resulting from your use of our products.

8. PRIVACY POLICY

8.1. Please refer to our Privacy Policy, which is an integral part of these Terms and Conditions.

9. CONTESTS AND GIVE-AWAYS

8.1 Eligibility: The giveaway is open to individuals who are at least 18 years old and residents of the country in which the giveaway is being held. Void where prohibited by law.

8.2 Entry requirements: To enter, participants must follow the Instagram account hosting the giveaway, like the giveaway post, and tag at least one friend in the comments. Multiple entries are allowed but each entry must tag a different friend. Any entries that are incomplete, illegible, or fraudulent will be deemed invalid.

8.3 Prize: The prize(s) will be clearly stated in the giveaway post. No substitutions or cash equivalents will be offered.

8.4 Winner selection: The winner(s) will be selected at random from all eligible entries. The selection will be conducted by the account hosting the giveaway and their decision will be final. The winner(s) will be notified via Instagram Direct Message within 48 hours of the giveaway closing. If a winner does not respond within 72 hours, another winner will be selected.

8.5 Publicity: By entering the giveaway, participants grant permission to the account hosting the giveaway to use their name and Instagram handle for promotional purposes without further compensation.

8.6 Disclaimer: The account hosting the giveaway is not responsible for any lost or stolen entries or prizes, or any technical malfunctions that may affect the giveaway.

8.7 Privacy: The account hosting the giveaway will not share any personal information collected during the giveaway with any third party without the participant’s explicit consent.

8.8 This giveaway is in no way sponsored, endorsed, or administered by Instagram. By entering, participants release Instagram from any responsibility or liability associated with the giveaway.

8.9 This giveaway is subject to all applicable laws and regulations.

8.10 The account hosting the giveaway reserves the right to modify or cancel the giveaway at any time without notice.

10. CONFLICT OF TERMS AND CONDITIONS

10.1. If there is any conflict or inconsistency between the provisions of these Terms and Conditions and any other relevant terms and conditions, policies, or notices, the other terms and conditions, policies, or notices that relate specifically to a particular section of Maglia will take precedence.

11. SEVERABILITY

11.1. If any provision of these Terms and Conditions is deemed unenforceable or invalid by any jurisdiction, court, or authority, the remaining provisions will still be valid and enforceable.

12. LAWS AND DISPUTES

12.1. These Terms and Conditions are governed and interpreted in accordance with Dutch laws.

12.2. Contracts made through the Site and any disputes arising from them will be governed by Dutch law. An amicable solution (through an ombudsman system) should be sought before seeking judicial remedies. If an amicable solution cannot be reached, disputes will be settled by Dutch courts, but this provision does not deprive European consumers of their national statutory rights.

12.3. If you are unable to resolve a dispute with Maglia, you can submit a complaint to the EU’s online dispute resolution platform at http://ec.europa.eu/odr.
